Welcome to Be Your Kind (accessible from beyourkindshop.com). By using our website and services, you agree to comply with and be bound by the following Terms of Service. Please review them carefully.
1. Description of Service
Be Your Kind provides an artificial intelligence design platform that allows users to write descriptive text prompts, choose apparel products (such as T-Shirts, Hoodies, Mugs, or Gift Cards), select art style styles, and generate custom preview designs. Users can also purchase tokens to generate designs or order physical products customized with their generated designs.
2. User Accounts and Registration
To generate designs beyond the initial guest trial limits (3 generations) and save creations to a profile, you must register for an account using email/password or OAuth providers (Google, Apple). You are responsible for keeping your login credentials secure.
3. Tokens and Generation Credits
Generating designs requires the use of tokens (1 token per active artist selection). Tokens can be purchased in packages (such as 18 tokens for $4.99) via Stripe.
- No Refund Policy: All purchases of digital tokens are final, non-refundable, and non-voidable. Tokens hold no cash value, cannot be converted to physical currencies, and are non-transferable between accounts.
- Fulfillment: Purchased tokens will be automatically credited to your user profile upon successful verification of transaction clearance received from our payment processor.
4. Physical Product Orders, Shipping, and Returns
Physical custom apparel and printed merchandise orders are produced, printed, and shipped via our third-party printing partner, Printify.
- Custom Order Production: Because all physical merchandise (such as shirts, hoodies, and mugs) are printed-on-demand and customized with your unique design selections, orders enter production immediately upon payment clearance and cannot be modified or cancelled.
- Defective or Damaged Products: Customized physical products are eligible for a replacement or refund only if they arrive damaged, defective, or incorrect. To submit a claim, you must contact support with photographic evidence of the issue within 14 days of receipt.
- Return Shipping Fees: In the event that a return is authorized or requested, the customer is solely responsible for arranging and paying all associated return shipping costs. Shipping fees paid at checkout are non-refundable.
5. Acceptable Use and Content Guidelines
You agree not to submit design prompts that contain hateful, offensive, sexually explicit, copyrighted, or illegal content. Be Your Kind reserves the right to terminate accounts that violate these guidelines or attempt to exploit the generation infrastructure.
6. Limitation of Liability
Be Your Kind is provided "as is" and "as available". We do not guarantee that the generated images will always meet your exact artistic expectations or that the service will be entirely free of interruptions. In no event shall Be Your Kind be liable for any indirect, incidental, or consequential damages resulting from your use of the website or customized apparel.
